Verifiable Retail Value of Prize:

Apple® iPod Touch 8GB retail value of Two-Hundred Ninety-Nine Dollars ($299.00)

Statement of Odds:

The chances of winning the Apple® iPod Sweepstakes is one (1) in One Million (1,000,000). There will be one (1) Apple® iPod Touch 8GB awarded from entries submitted from February 1, 2008 through December 31, 2008. The winner will be selected within thirty (30) days from the end of the contest. Winners will be notified in writing or by phone.

Eligibility Limitations:

1. Must be a resident of the United States of America.
2. Only one (1) individual per entry.
3. Participants are only allowed one (1) entry per day.
4. Winners under the age of 18 must have Parent or Guardian sign a statement of eligibility and release of liability in order to receive prize.
5. Limit one (1) prize per person/family/household per twelve (12) month period.

Rules:

1. No Winning Ticket or Proof of Purchase required to redeem prize.
2. Contest begins on February 1, 2008 and ends on December 31, 2008.
3. One (1) Apple® iPod Touch 8 GB will be awarded to one (1) winner.
4. No Purchase Required to enter the Apple® iPod Touch 8 GB Sweepstakes.
5. Modern Foods an/or an agent of its choosing will randomly select the winning entry from all entries received after December 31, 2008.
6. Winners will be required to sign a statement of eligibility and release of liability in order to obtain prize.
7. Employees of Modern Foods, its agencies, suppliers, judges and immediate family and household members are not eligible.
8. Winner will be notified within thirty (30) day of the end of the contest period and will have ten (10) days to provide a statement of eligibility and release of liability.
9. If the statement of eligibility and release of liability is not returned in the stated time period an additional entry will be chosen and the process repeated until a statement of eligibility and release of liability from a selected entry id returned in the time period.
10. Modern Foods retains the right to discontinue the sweepstakes at any time, provided the Apple® iPod Touch 8 GB is awarded.
11. Official Rules and the decisions of Modern Foods and/or its agents are final and binding in all respects.
12. Winners are responsible for all federal, state and local taxes in conjunction with any prize won in the Modern Foods Apple® iPod Sweepstake.
13. Any and all federal, state and local laws apply to the contest.
14. Contest is void where prohibited or restricted by law.
15. Modern Foods and its agents are not responsible for technical failures in entry transmission or for lost, misdirected or delayed submissions.
16. Modern Foods and its agents are not responsible for any damage to participant's computer occasioned by participation in this contest.
17. Modern Foods and its agents shall not be liable for any claim, injury or damage from any Modern Foods contest or prize awarded in a contest.
18. For a list of winners, send a self-addressed stamped business-size envelope (#10) to Dwight Yoakam's Bakersfield Biscuits™ brand iPod® Sweepstakes c/o Modern Foods, P.O. Box 908, Peru, IN 46970. Requests for the winners list must be received by May 1, 2009. Vermont residents need not include return postage.
